No win, no fee injury lawyers – is it always no win no fee?

Many personal injury cases these days are on a ‘no win, no fee’ basis. If the claim is unsuccessful, the claimant pays nothing, although there will be certain situations where a sum may be due and the website of any regulated personal injury lawyer should specify these exceptions (usually asterisked with info in the footer or on their terms and conditions page). Also, note that no win no fee doesn’t necessarily mean that should you win you get to keep all of your compensation – only certain firms provide a 100% compensation legal service and you should study the terms and conditions of any law firm’s site before instructing. Bear in mind that should the firm charge a higher rate than others, that doesn’t mean they should always be avoided – indeed they may be so skilled and so experienced that they can earn you a much higher amount potentially. A famous Scottish injury law firm, for instance, advertises that on average they’ll secure 3 times the typical claim amount.

How do I choose a personal injury lawyer in the UK?

  1. Use a search engine to search for the ‘best personal injury lawyer near me’ or similar – for your location
  2. Ask family/friends/locals (in person, on Whatsapp, Facebook – e.g. in local pages etc) for recommendations
  3. Consider some of the ones we’ve listed
  4. Read their online reviews – are they mostly 5 stars?
  5. Arrange meetings with 3 or so of the top personal injury lawyers you find as a result
  6. Ask for quotes, ask for expected compensation amounts and find out what percentage of your compensation they’ll keep as their fee
  7. Hire the best one that you like and trust the most.

What is the average settlement for a personal injury in the UK?

In the UK, the best guide to the average compensation settlement figure you’re likely to receive for your injury is the Judicial College Guidelines (JC Guidelines or JCG) formerly known as the Judicial Studies Board Guidelines, JSB Guidelines or JSB. This annually updated guidance sets the advised general damage compensation levels that the Judicial College sets. For example, an average moderate shoulder injury claim could be worth £6,000 to £9,700, while a severe head/brain injury claim could be worth £214,350 to £307,000, or a minor back injury could range from a few hundred pounds to £9,500. Each personal injury claim, however, will have its own unique circumstances that will have to be taken into account. This generally includes the extent of the injuries and consequences for your emotional state and quality of life (e.g. can you still work as a result of your injuries?). The law differs in this respect between Scotland and England & Wales so it’s important to choose a lawyer from your jurisdiction. But again all of this is dependent on your unique circumstances including the impact your injury has had on your day to day life so it’s best to seek specialist legal advice tailored to your situation.
