Further to my initial post here and Professor Hector MacQueen’s update here, the Walls v Santander judgment, available here, has been appealed to the European Court of Human Rights (ECtHR) under Article 6 of the ECHR: the Right to a Fair Trial. Of course, it has to be remembered that success at the ECtHR, which won’t be the quickest decision ever, will still require a decision on the substance of the case in the courts of Scotland…or perhaps the Supreme Court?
