Walls takes Santander and its Bank Charges Case to the ECtHR under Article 6 ECHR: the Right to a Fair Trial

by WardBlawg on July 23, 2010

Further to my initial post here and Professor Hector MacQueen’s update here, the Walls v Santander judgment, available here, has been appealed to the European Court of Human Rights (ECtHR) under Article 6 of the ECHR: the Right to a Fair Trial. See Govan Law’s commentary here and subsequent coverage in the Journal Online here.

WardblawG supports the ECtHR move in its entirety and wishes Ms Allison Walls the best of luck. May Justitia swing her sword in her favour.

Of course, it has to be remembered that success at the ECtHR, which won’t be the quickest decision ever, will still require a decision on the substance of the case in the courts of Scotland…or perhaps the Supreme Court?
